Boat License Spain: Do You Need One to Rent a Boat?

Yes, in almost every case. From 1 October 2026, anyone who drives a rented boat in Spain must hold at least a Spanish licencia de navegación or a recognised licence, because the old licence-free rental of small motorboats (up to 5 m and about 15 hp) ends. For a bareboat yacht you need a licence from your EEA country of nationality or residence, or a recognised one such as the UK RYA certificates. With a skipper, you need none.

Rules last checked: 25 September 2026. Spanish rules can change, so confirm with the charter company or the Spanish maritime authority before you sail.

Do you need a boat license in Spain?

Spain's licence rules are national (Real Decreto 875/2014) and apply the same way in Mallorca, Ibiza, Menorca, the Costa Brava, the Costa del Sol and the Canary Islands. In short:

  • Driving a rented boat yourself: you need a licence. From 1 October 2026 this also applies to the small motorboats that used to be rented without one.
  • Bareboat charter of a yacht: you need a licence that covers the size of the boat and the sea area, and Spain must recognise it.
  • Charter with a skipper or crew: you need no licence. The skipper holds it.
  • Your own small boat, private use: motorboats up to 5 m and 15 hp, and sailboats up to 6 m, are still licence-free within strict limits.

What changes on 1 October 2026?

Until 30 September 2026, Spanish law let anyone aged 18 or over drive a motorboat of up to 5 m and 11.26 kW (about 15 hp) without a licence, as long as they stayed within 2 nautical miles of a port, marina or sheltered place and only sailed in daylight.

Real Decreto 1188/2025, published in the Spanish official gazette (BOE) on 30 December 2025, rewrites this rule from 1 October 2026. The exemption now covers only private use. The decree says that when these boats are rented out, the person renting must hold the relevant licence, and it gives the high number of incidents and accidents as the reason.

In practice: if you plan to rent a small motorboat on a Spanish beach and drive it yourself, bring a licence or get a licencia de navegación first. The same applies when you compare motorboats for rent: check what the listing asks for.

Which boats can you drive without a licence in Spain?

From 1 October 2026, the BOE text of Real Decreto 875/2014 lists these exceptions:

  • Motorboats up to 5 m with a maximum rated power of 15 hp (15 CV) and no power-limiting device, for private use.
  • Sailboats up to 6 m for sporting use.
  • Floating or beach craft, such as pedal boats.

For all three, you must be at least 18, stay within 2 nautical miles of the port, marina or beach you left from, and only go out in daylight. Jet skis are never licence-free.

Whether a rented sailing dinghy of up to 6 m is still covered is not clear-cut. The decree keeps the sailing exemption for sporting use, but the reason for the change is to stop unlicensed rentals. Ask the rental company before you book.

What is the licencia de navegación?

The licencia de navegación is Spain's most basic boating qualification. It is issued by Spanish sailing and motorboat federations and by nautical schools. According to the decree:

  • It covers boats and jet skis up to 6 m, with an engine suited to the boat.
  • You may only go out in daylight and stay within 2 nautical miles of a port, marina or sheltered place.
  • The training is 2 hours of theory and at least 4 hours of practice on the water.
  • You need a medical check, and you must be 18, or 16 with written consent from a parent.

It suits a day on a small boat, not a charter yacht. Ask a Spanish nautical school whether it can issue one to you as a visitor.

Which foreign boat licences does Spain accept?

For boats flagged in Spain, which covers nearly all rental and charter boats there, the decree accepts a valid recreational licence or certificate that meets two conditions:

  • It was issued by the country of your nationality or residence.
  • That country is in the European Economic Area (EU plus Norway, Iceland and Liechtenstein), or is one of the countries listed in annex IX of the decree.

Annex IX lists Andorra, Argentina, Canada, Chile, Switzerland, the United Kingdom, Uruguay and Venezuela. The United States and Australia, for example, are not on the list. If your licence comes from a country that is not listed, you cannot skipper a Spanish-flagged boat on it, and you should book with a skipper.

Spain also only accepts your licence within the limits it gives you at home. A licence for motorboats does not cover a sailing yacht, and a licence limited to 5 nautical miles from the coast does not cover a longer passage.

UK licences in Spain

Annex IX lists these RYA certificates, with these limits for Spanish-flagged boats:

  • Yachtmaster Ocean: up to 24 m, no distance limit.
  • Yachtmaster Offshore: up to 24 m, within 150 nautical miles of the coast.
  • Coastal Skipper / Yachtmaster Coastal: up to 24 m, within 20 nautical miles.
  • Day Skipper: up to 24 m, within 12 nautical miles.
  • Powerboat Level 2: motorboats up to 10 m, within 5 nautical miles.
  • ICC: as stated on the certificate, for example up to 24 m within 12 nautical miles.

If you skipper a boat flagged in another country, Spain asks for the licence required by your country of nationality or residence.

Does Spain accept the ICC?

Spain has not adopted UNECE Resolution 40, the agreement behind the International Certificate of Competence (ICC). The RYA still recommends the ICC for Spain, and the Spanish decree lists the UK-issued ICC by name. If you are an EEA citizen and your home country issues an ICC, it counts as a certificate from your country of nationality, within the limits printed on it.

Can you charter a boat in Spain without a licence?

Yes. When you charter with a skipper, the skipper holds the licence and is in charge of the boat, so you need no licence at all. On a crewed charter, the skipper is joined by a host or chef.

What happens if you sail without a valid licence?

Under Spain's Ports and Merchant Marine Act, skippering without a sufficient licence, or beyond the limits of your licence, is a serious offence against maritime safety. The legal maximum fine is EUR 180,000, and the actual amount is decided case by case. The RYA notes that Spanish authorities do inspect certificates. The charter company can also refuse to hand over the boat if your papers do not match it.

Yes, from 1 October 2026, if you drive it yourself. The rules are the same across Spain, including the Balearic and Canary Islands. Book a boat with a skipper if you have no licence.

Can I rent a small motorboat of up to 15 hp without a licence in Spain?

Is a US boating licence valid in Spain?
